•Automated data harvesting (bots, scrapers, crawlers)
•Framing or hot-linking ShopSmart content

Trademark Rights — 15 U.S.C. § 1051 et seq.

The following marks are claimed as trademarks of House of Pain Tattoo LLC. Any unauthorized use of these marks — including in domain names, social media handles, product names, or advertising — constitutes trademark infringement under the Lanham Act (15 U.S.C. § 1114) and may result in civil liability and injunctive relief.

Civil Penalties:

Criminal Penalties (17 U.S.C. § 506):

Product names, brand names, logos, and images associated with third-party suppliers (Mountain Rose Herbs®, Charlotte's Web®, Joy Organics®, FK Irons®, Dragon Hawk®, Augason Farms®, True Leaf Market®, High Mowing Seeds®, Ready America®) remain the exclusive property of their respective owners. ShopSmart's display of these trademarks constitutes nominative fair use under trademark law and does not imply endorsement, affiliation, or sponsorship unless expressly stated.

All product images are used under license from respective suppliers, royalty-free photography services, or AI-generated imagery owned by House of Pain Tattoo LLC. No product images may be reproduced without written permission from both House of Pain Tattoo LLC and the original image rights holder.
