Overview

House of Pain Tattoo LLC ("Company") respects the intellectual property rights of others and expects users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (DMCA, 17 U.S.C. § 512), we will respond expeditiously to claims of copyright infringement reported to our designated copyright agent.

Reporting Copyright Infringement — Takedown Notice

If you believe content on ShopSmart infringes your copyright, provide our Designated Agent with a written notice containing ALL of the following (incomplete notices will not be processed):

  1. A physical or electronic signature of the copyright owner or authorized agent
  2. Identification of the copyrighted work(s) you claim has been infringed
  3. Identification of the material on ShopSmart that you claim is infringing, with enough detail for us to locate it (include the URL)
  4. Your name, address, telephone number, and email address
  5. A statement that you have a good-faith belief that use of the material is not authorized by the copyright owner, its agent, or the law
  6. A statement that the information in your notice is accurate, and under penalty of perjury, that you are the copyright owner or authorized to act on the copyright owner's behalf

Counter-Notice Procedure

If your content was removed and you believe it was wrongly removed (e.g., you have authorization to use it, or it constitutes fair use), you may submit a counter-notice to the same Designated Agent containing:

  1. Your physical or electronic signature
  2. Identification of the removed material and its prior location
  3. A statement under penalty of perjury that you have a good-faith belief the material was removed as a result of mistake or misidentification
  4. Your name, address, telephone number, and consent to jurisdiction of the federal district court in the Northern District of Illinois

Upon receiving a valid counter-notice, we will forward it to the original complainant and may restore the material within 10–14 business days unless the complainant files a court action.

Repeat Infringers

In accordance with 17 U.S.C. § 512(i), House of Pain Tattoo LLC will terminate the accounts of users who are found to be repeat infringers of intellectual property rights.

Misrepresentation Warning

Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that content is infringing, or that content was removed by mistake, may be liable for damages, costs, and attorneys' fees.
