Federal Legal Status — 2018 Farm Bill

All hemp-derived CBD products sold by ShopSmart contain less than 0.3% delta-9 tetrahydrocannabinol (THC) on a dry weight basis, as required by the Agriculture Improvement Act of 2018 (2018 Farm Bill), Public Law 115-334. Hemp and hemp-derived products meeting this THC threshold were removed from Schedule I of the Controlled Substances Act and are federally legal in the United States. ShopSmart sources CBD products exclusively from USDA Certified Organic suppliers with current Certificates of Analysis (COA) from ISO 17025-accredited third-party laboratories confirming THC content below 0.3%.

State-Level Restrictions

While hemp-derived CBD is federally legal, some states have enacted additional restrictions. ShopSmart automatically blocks CBD orders shipping to the following jurisdictions: • Idaho (ID): Hemp CBD is prohibited under Idaho Code §37-2701. CBD products will NOT ship to Idaho. • Iowa (IA): CBD products may only be sold for medical purposes under Iowa law. Exercise caution. • Nebraska (NE): State restrictions on certain hemp CBD products apply. Orders may be blocked. • South Dakota (SD): State hemp laws have evolved; some restrictions may apply. • Kansas (KS): Certain CBD products face restrictions; only THC-free products may be permitted. Customers are responsible for knowing their local laws. ShopSmart blocks CBD shipping to Idaho and flags orders to other restricted states. This list is updated as laws change.

International Shipping Restrictions

CBD products cannot be shipped to countries where hemp-derived CBD is prohibited or heavily regulated. This includes, but is not limited to: China, Russia, Malaysia, Singapore, Philippines, Thailand, Indonesia, Vietnam, United Arab Emirates, Saudi Arabia, Kuwait, and Qatar. The checkout system automatically prevents CBD orders to these countries. This list is not exhaustive. Customers are responsible for compliance with their country's import laws.

Third-Party Testing & Certifications

All CBD products sold on ShopSmart are sourced from suppliers with: • USDA Certified Organic certification by accredited certifying agents • ISO 17025-accredited third-party laboratory testing for potency, purity, and safety • U.S. Hemp Authority® Certification Program participation • Certificates of Analysis (COA) available for every production batch • Good Manufacturing Practice (GMP) certified facilities • Non-GMO Project Verification Certificates of Analysis are available directly from our suppliers upon request. Age Restriction

CBD and hemp products are sold to customers aged 18 and older only. Age verification is required at checkout. By purchasing CBD products from ShopSmart, you confirm that you are 18 years of age or older and legally permitted to purchase hemp-derived CBD products in your jurisdiction.

Illinois Law

ShopSmart is operated by House of Pain Tattoo LLC in Rockford, Winnebago County, Illinois. Illinois permits the sale and distribution of hemp-derived CBD products under the Illinois Industrial Hemp Act (505 ILCS 89) and the Illinois Cannabis Regulation and Tax Act (410 ILCS 705), which explicitly allows hemp-derived CBD with <0.3% THC. Illinois law is consistent with the 2018 Federal Farm Bill.

Governing Law & Dispute Resolution

All disputes related to hemp and CBD products purchased on ShopSmart are governed by the laws of the State of Illinois, without regard to conflict-of-law provisions. Any disputes shall first be subject to binding arbitration under the American Arbitration Association (AAA) Commercial Arbitration Rules, to be conducted in Winnebago County, Illinois. Nothing herein waives any consumer protection rights under Illinois law (815 ILCS 505/ — Illinois Consumer Fraud and Deceptive Business Practices Act) or any applicable federal law.
